Terms of Use — End User License Agreement (EULA)

mAI Whisky & mAI Wine — As of: April 2026

This End User License Agreement ("EULA") is a binding contract between you ("User") and the Licensor:

By downloading, installing or using the mobile applications "mAI Whisky" and/or "mAI Wine" (together: the "App"), you agree to be bound by this EULA. If you do not agree, do not download or use the App.

1. License Grant

The Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the App on any Apple-branded device that you own or control, and as permitted by the Apple Media Services Terms and Conditions and Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula), which also applies to the App.

2. Auto-Renewable Subscriptions

• Title: mAI Premium (Monthly) and mAI Premium (Yearly).
• Length: Monthly subscription renews every 1 month; Yearly subscription renews every 12 months.
• Price: The exact price and any price per unit are shown in the App on the subscription screen and in the App Store before purchase. Prices may vary by region.
• Payment: Payment is charged to your Apple Account at confirmation of purchase.
• Auto-renewal: The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
• Management & cancellation: You can manage your subscription and turn off auto-renewal at any time in your Apple Account Settings after purchase.
• Scope of Premium: A single mAI Premium subscription covers both mAI Whisky and mAI Wine under the same Apple Account.
• Free trial (if offered): Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

3. Permitted Use

• You may use the App only for personal, non-commercial purposes related to managing a beverage collection and running tastings.
• You must be at least 18 years old to use the App. Content relates to alcoholic beverages and is not intended for minors.
• You must keep your login credentials confidential and are responsible for activity on your account.

4. Restrictions

You may not:

• Copy, modify, adapt, translate or create derivative works of the App, except as permitted by applicable law.
• Reverse engineer, decompile or disassemble the App, except to the extent such activity is expressly permitted by applicable law.
• Rent, lease, lend, sell, redistribute or sublicense the App.
• Use the App for any unlawful or abusive purpose, or in a way that interferes with its operation.
• Access the App via automated means (bots, scrapers) or attempt to circumvent any security or rate-limit mechanism.
• Upload content that is illegal, infringing, offensive or violates third-party rights.

5. User Content and AI-Generated Content

• User-generated content (ratings, notes, photos) remains your property. You grant the Licensor a worldwide, non-exclusive, royalty-free license to host, store, reproduce and display such content solely as required to provide the service.
• The App uses third-party AI services (e.g. OpenAI) to generate summaries, recognize bottles and compute flavor profiles. AI output is generated automatically, may be inaccurate, and does not constitute professional advice.
• Data sent to AI providers is described in the Privacy Policy. You can enable or disable AI features at any time in the App's settings.

6. Intellectual Property

The App, including all software, design, text, graphics and trademarks, is owned by the Licensor or its licensors and is protected by copyright and other laws. No rights are granted to you except the limited license expressly stated in this EULA.

7. Updates and Availability

• The Licensor may provide updates, bug fixes and new features, and may modify or discontinue features at any time.
• The Licensor aims for high availability but does not guarantee uninterrupted, timely, secure or error-free operation.

8. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, non-infringement, or accuracy of AI-generated results, except for warranties that cannot be excluded under applicable law.

9. Limitation of Liability

• The Licensor is fully liable for intent and gross negligence.
• For slight negligence, the Licensor is only liable for breaches of essential contractual obligations, limited to the foreseeable, typical contractual damage.
• Liability for damages arising from AI-generated content is excluded to the extent permitted by law.
• Liability for data loss is limited to the typical recovery costs that would have arisen with regular data backup by the User.
• Mandatory statutory liability (including under product liability law) remains unaffected.

10. Termination

This EULA is effective until terminated. Your rights under this EULA end automatically if you fail to comply with any term. Upon termination, you must stop all use of the App and delete it from your devices. You may delete your account at any time in the App's settings; all your personal data will be permanently removed.

11. Third-Party Services

The App relies on third-party services (Apple App Store, RevenueCat, OpenAI, Railway, Cloudflare). Your use of these services is subject to their respective terms. Apple Inc. is not a party to this EULA and is not responsible for the App or its content, but is a third-party beneficiary entitled to enforce this EULA against you.

12. Changes to this EULA

The Licensor may amend this EULA. Registered users will be notified by email of material changes. Continued use of the App after changes take effect constitutes acceptance.

13. Governing Law and Jurisdiction

• The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• Mandatory consumer-protection provisions of the User's country of residence remain unaffected for consumers.
• Jurisdiction for merchants is Attendorn, Germany.
